No, not necessarily...according to the cops he was cooperative...and it appears he was not drunk. That said, even if he was, often times cops will just ride a person home who happens to be drunk...if that is the case, but here, they put together a bogus trepassing charge...when they could have simply asked him to obey the security guards demands as soon as they, the cops, arrived on the scene.

Again...the cops said that Shia was cooperative...so why didn't the cops explain the law to the actor, and then ask him to leave, or face arrest--case closed??? I'll tell you why, because they wanted to arrest somebody famous...that's why.

And let me remind you, there have been no "public intoxication" charges filed against LaBeouf by the police, so it seems that the cops didn't share the guard's viewpoint that Shia was drunk...or even high...which calls into question the guard's story...as well as the standing trespassing charge. The latter charge, of course is immediately placed into question due to the guard, claiming that he asked Shia to leave the store solely thanks to his suspicion that he was drunk...or at least, appeared to be drunk. Well, if that guard was wrong about that charge, then he had no right to ask LaBeouf to leave the store in the first place.</description>
